Markus Frick – Wikipedia

Markus Frick (* August 24, 1972 in Sinsheim) is a German stock market speculator, stock exchange and stock exchange author author.

Frick is a trained baker. According to his own statements, he was already interested in the stock exchange as a teenager. In his first book published in 2001 I make her rich He described how he wants to have made a million DM from an investment capital of DM 100,000 within one year of DM 100,000. [first] He later published further books as well as DVDs and audio CDs on financial issues. Its awareness began with the boom in the Neuer Markt and the resulting media presence. In the summer of 2001 he had a performance in Stefan Raab’s broadcast TV total .

Frick organized seminars and workshops on the subject of stock trading and was the author and publisher of several stock market letters ( Markus-Frick-Email-Hotline , Markus-Frick-Inside , Frick-Trading , MoneyMoney ). His so-called “10,000 euro facility” has caused a sensation since 2005. It was a sample depot in which he tried to increase his originally (fictitious) capital that was originally used within a calendar year. Since June 2007, however, he has tried not to reduce the remaining capital. From 2006 to June 2007, Frick moderated the weekly stock exchange magazine on the private television station N24 Make Money – Die Markus Frick Show , [2] The “call-in formats”, which was strongly based on American, is primarily Mad Money by Jim Cramer to CNBC. [3]

At the beginning of July 2007, according to Frick’s Internet homepage, the responsible partnership was Finance Communications (Owner: Markus Frick) by the Finanzdialog Verlag GmbH (Managing Director: Roland Sadowi). From a legal point of view, it was no longer possible to conclude contracts directly with the person Markus Frick. However, Frick was liable for contracts concluded with his private assets. [4]

According to their own statements, over 200,000 people have visited their stock market seminars.

On his homepage, Frick announced the start of his new TV show for 2008 Money Money . Since there was no TV station for this, it was Money Money Only accessible on the Internet, e.g. B. on YouTube and on www.moneymoney.tv. According to his own statements, Frick exceeded the former quotas of the prematurely set N24 show. [5]

Frick moderated since 2009 Money Money Together with Jan Pahl. It was particularly striking that his new projects such as B. www.moneymoney.tv the name Markus Frick was not found on the entire website. In addition, the public presentation was carried out within Jan Pahl published by Frick. A PID Plata Information Service GmbH (formerly ISP Finanz GmbH), based in Berlin, was mentioned as the responsible operator. In addition to a weekly TV show on the Internet, a DVD entitled “So you will also find 1,000% shares” was offered for sale.

On June 16, 2007 [6] took N24 The stock market magazine Make Money From the program. The Federal Supervisory Authority Bafin checked whether Frick has carried out banned course manipulations with his email newsletter. Frick was accused of having “high” worthless shares in order to obtain commission from the companies concerned. [7] [8] After some of the shares recommended by Frick in June 2007 within a few days of 80 to 90 percent in the course, the speculative losses of the subscribers to his stock market letters were estimated on a three -digit million amount in euros. [9] [ten]

The Berlin public prosecutor’s office determined against Frick because he could have manipulated stock market courses in a “punishable manner” and thus committed a violation of the Workers Act (WPHG). [11] At the beginning of October 2007, the Berlin public prosecutor’s office searched for various private and business premises by Markus Frick as part of the investigation. [twelfth]

In August 2008, a former subscriber obtained a court decision to secure his claim for damages. In addition, the Berlin public prosecutor’s office against Frick is investigating for the allegation of criminal market manipulation (Az.: 3 Wi JS 1665/07). [13] In the decision of the Berlin Regional Court of May 20, 2008 (file number: 514 AR 1/07) it said: “… the accused benefited significantly from his course fraud through his own sales, which would not be necessary to fulfill the criminal law at all,, d. that is, in the sense of the aforementioned case law of the BGH, he pursued the course fraud ‘own purposes’. … from the previous findings of the investigation, namely the BaFin reports, the suspicion of money laundering and the information from the witness … results in a high suspicion that tends to be urgently urgent. ” [14]

In the course of the investigation, around € 80,000,000 has already been attached. It should be the sales proceeds achieved. Frick denied this. [15] [16]

Frick made a constitutional complaint against the implementation of the decision of the district court in Berlin to grant the requested file inspection for the victims (Az.: 514 AR 1/07). The enforcement was therefore initially exposed to the decision of the Federal Constitutional Court on June 2, 2008 until a decision on the constitutional complaint – at the latest for a period of six months (interim arrangement 2 BvR 1043/08).

By decision of December 4, 2008, the Federal Constitutional Court decided that Frick’s constitutional complaint against the possibility of inspection of files was not accepted for decision (2 BvR 1043/08). The decision is incontestable and inspection of the file for the injured party now seemed without restrictions. [17]

However, in a later decision of February 15, 2010, the LG Berlin expressly decided against a right of the invoice for the victim. Investors are against violations of violation § 20a WPHG no injuries in the sense of the § 406e Stpo. This interpretation is also compatible with the decision of the Federal Constitutional Court (BVerfG). [18]

Markus Frick was arrested in January 2013 on suspicion of renewed market manipulation and commercial fraud. [19] [20]

The Berlin public prosecutor’s office brought charges against the former N24 exchange consultant Markus Frick on suspicion of criminal market manipulations on the stock market. Frick, who was confessed between September 2005 to June 2007, is said to have recommended shares traded by E-Mail in 49 cases on the Frankfurt Stock Exchange and pursued their own economic interests, said the spokesman for the Berlin public prosecutor, Martin Steltner, on August 19, 2009. According to the findings of the Federal Financial Supervisory Authority (BaFin), the recommendations of the accused would have led to significant price increases or stabilizations. In the vast majority of cases, Frick is said to have exploited the course increases caused by his recommendations by selling the securities he has held on a large scale.

In 23 cases, according to the public prosecutor’s office, “international stock market machinations” was based on the so-called pump-and-dump model on which the companies “Star Energy Corp.”, “Stargold Mines Inc.” and “Russoil Corp.” relate.

Through accounts of several companies in Panama at Panama at well -known banks in Switzerland, two separately persecuted men would have introduced worthless shares in the free traffic of the Frankfurt securities exchange. As a result of the recommendations, the stock market courses of the companies rose to top values before they crashed to near zero within a very short time from mid -2007.

According to the public prosecutor, BaFin’s surveys showed that more than 20,000 investors acquired a total of over 760 million euros in shares in the three companies. Due to the subsequent “rapid price drop”, many small investors in particular had suffered a total loss. After the allegations became known, N24 discontinued the Fricks show in June 2007.

As the public prosecutor explained, however, over 80 million euros could be secured on accounts and depots. [21] [22]

In an exchange letter from May to April 2012, Frick is said to have recommended three stock titles to target their course. [23] In the proceedings before the Frankfurt Regional Court, Frick granted a violation of the securities trade law. The public prosecutor raised charges for fraud and applied for two years and three months in prison. [24]

In February 2008, Frick from the Heidelberg District Court (Az.: 2 O 261/07) was sentenced to a subscriber from his hotline. [25] The verdict was the first, numerous procedures were still pending at the time. [26]

Frick appeal at the OLG Karlsruhe made against the judgment of the LG Heidelberg (Az. 10 U 29/08). Frick justified the appeal u. so that “The plaintiff deliberately realized the losses in order to be able to carry out a trial against the defendant.” [27]

In April 2011, the Berlin Regional Court condemned a fine in the double -digit millions of millions for punishable market manipulation. According to the court order, Frick has to pay 420,000 euros from his private assets to the state treasury; 42 million euros are to flow from an obviously Frick foundation in which Frick has stock packages. In addition, he was sentenced to a probation penalty of 1 year and 9 months. [28] [29] According to the court between September 2005 and June 2007, he had recommended for purchase in 49 accused cases in his stock market letters, which he himself had, but hid his readers his own economic interest.

The Frankfurt Regional Court sentenced him to two years and seven months in prison in February 2014 for intentional manipulation of share prices. The court saw it as proven that in 2012 it influenced the courses of three for values with the help of targeted recommendations and received money from back men who sold their shares at excessive prices. In November 2013, Frick admitted that he had received 1.9 million euros in cash in return for the recommendation of a paper. [30]
