The Tuscan district It is an Italian electoral district for the election of the Senate of the Republic.

The electoral district was established, with another 19, for the first elections of the Senate of the Republic, by law of February 6, 1948, n. 29 [first] in compliance with the establishment of the Italian Republic which prescribes, in art. 57, that “the Senate of the Republic is elected regional based”. It was divided into 15 list colleges, based on the Presidential Decree of 6 February 1948, n. 30. [2]

In compliance with the aforementioned article, the district was reconfirmed later in all the electoral laws inherent in the Senate of the Republic.

The law of 4 August 1993, n. 276 [3] changed the territory by dividing it into 14 uninominal colleges, based on Legislative Decree of 20 December 1993 n. 535. The aforementioned colleges were abolished by the law of 21 December 2005, n. 270. [4]

The current law 3 November 2017, n. 165, has recreated in the territory of the district uninominal colleges and plurinominal colleges that must be determined by the government by legislative decree. [5]

The territory of the district corresponds, from its institution, to that of the Tuscany Region.

For the attribution of the seats due to each region, it must also be compared in this case to the establishment of the Italian Republic which prescribed, on the date of promulgation of 1948, that “no region can have a number of senators less than six. The Aosta Valley has only one senator “, modified then with the constitutional law 9 February 1963, n. 2 which reads «no region can have a number of senators lower than seven; Molise has two, the Aosta Uno Valley. ”

Starting from a constitutional minimum of six seats by region, which later became seven, the distribution of the seats due to the district is carried out in proportion to the population of the regions, as it appears from the last general census, on the basis of the entire quotients and the highest remains.

Based on the law in force since 1948, essentially proportional, the parties presented a candidate for each college in each district. Within each college, the candidate who had reached the quorum of 65% of the preferences. If no candidate had achieved the election, the votes of all candidates were grouped on party lists at regional level, where the seats were allocated using the Metodo d’Hondtt Of the major statistical averages and therefore, within each list, candidates with the best preference percentages were elected senators.

With the 1993 majority electoral reform, in the first instance the candidate was elected Senator who had reported the relative majority of the suffrage in each college. No candidate could present himself in more than a college. The remaining regional seats were instead assigned by resembling the votes of all the uninominal losing candidates who had connected to a regional group, using the Metodo d’Hondtt Of the best averages: the ladders thus obtained by each group were assigned, within it, to the losing candidates who had obtained the best electoral percentages.

With the entry into force of the Calderoli law, a proportional electoral system with blocked lists, barrier threshold and majority prize on a regional basis, is adopted for the election of the Senate. To the distribution of the seats, which takes place according to the hare method of the whole quotients and the highest remains, the lists contribute that within the regional district have obtained at least 8% of the valid votes, or at least 3% if they are part of a coalition that has obtained at least 20%. In any case, the coalition or more voted single list is awarded at least 55% of the seats: if this threshold is not reached, a majority prize is awarded, in the form of additional seats, which reduces those attributed to other political forces.
